Contract Terms & Conditions
Every exhibit must be properly installed and ready for inspection by 9:00 AM on the opening day of the show November 17, 2020 and must REMAIN INTACT UNTIL 5:00 PM CLOSING DAY OF THE SHOW November 19, 2020. Failure to meet these requirements may cause exhibitor to be barred from future shows.
The space as stipulated in this contract is to be used solely for the exhibit named in this contract during GATEWAY 2020 and cannot be transferred or any portion of it sublet by the exhibitor or his agents.
Every exhibit shall be prepared in a neat and orderly style and must be kept clean by the exhibitor during the entire show.
Gateway/Kearney Farm Expo, Inc. and Buffalo County Ag Association will use all reasonable care to prevent loss or damage to exhibitor's property, but is not liable in any manner for such loss. Lessor is not responsible for any damage or theft of exhibits, merchandise, equipment, or other property owned by or in the custody of the Lessee. This includes any property while in the care, custody, or control of the Lessor, or representatives of the Lessor.
Gateway/Kearney Farm Expo, Inc. and Buffalo County Ag Assoc. reserve the right to control the use of any volume of any loudspeaker, radio, musical instrument or any noise making device that might interfere with exhibitors in the immediate area. Public address systems cannot be used.
Past exhibitors will have until January 15th, 2020 to receive priority consideration of booth location (e.g. last year’s booth or similar location). The event management has the right to make booth assignments as necessary to accommodate vendors and attendees.
50% of the “Total Registration Cost” is due with this completed contract. The balance of the total registration cost is due by September 1, 2020.
A refund of 50% of your “Total Registration Cost” will be made if space is canceled before September 1, 2020. No refunds will be made after September 1, 2020.
Dividers will be furnished for inside exhibitors at no additional cost. NO inside exhibit shall be constructed in such a way that it will interfere with the viewing of the exhibit next to it. Inside exhibit must be within the framework of the exhibit lot dividers.
No electrical connections will be made except by electricians employed by the Lessor and electrical fees are paid in full. 220 volt electricity is available in select areas for $75, for specific locations contact KAAPA Coop. Lessor shall not be responsible to Lessee for loss of time or revenue owing to power interruptions and utility failures. Exhibitors must furnish extension cords to connect electricity (inside or outside).
Gateway/ Kearney Farm Expo, Inc., and Buffalo County Ag Association will assume no liability for Bodily Injury, Death, or Property Damage arising from the existence or operation of Lessee's exhibit or activities. Lessee agrees to defend at its own expense, indemnify and hold harmless the Lessor from any and all liability penalties, damages, cost expenses, causes of action, and claims of every kind and nature arising from illness, death, bodily injury, or property damage to any person or property, occasioned by or growing out of any way connected with the occupation or use of the leased premises or activities associated therewith.
Lessee agrees to carry Public Liability Insurance, including Product Liability coverage, with Limits of Liability to be at least $100,000 Bodily Injury each occurrence, $300,000 Bodily Injury aggregate, and $100,000 Property Damage each occurrence. Said insurance must be in effect at any time in which Lessee is making any use of the premises. A certificate of insurance is not required by the Lessor.
Vehicles which are a part of the permanent display must be in place on the exhibit lot by 8:00 a.m. each day of the show. Vehicles which are not part of the permanent exhibit will not be allowed in the show area.
Any property of Lessee left on show premises after November 20, 2020 will become the property of the Buffalo County Ag Association.
Remittance must be received before this contract becomes valid. No exhibitor will be allowed to set up their display until ALL exhibit space fees and electrical fees (if any) are paid in full. Prior to setting up exhibit display, the exhibitor must first check in to verify that all fees have been paid.
